The 2025 Artificial Intelligence Law officially took effect on 1 March 2026, introducing key updates on AI classification, legal liability, and corporate obligations.
On 10 December 2025, the National Assembly passed the 2025 Artificial Intelligence Law (“AI Law”), which officially came into force on 1 March 2026. This law establishes a comprehensive legal framework governing artificial intelligence–related activities in Vietnam.
As AI is increasingly applied in business operations and management, understanding these new regulations is essential for enterprises.
Key Highlights for Businesses
1. Clear Identification of Participants in the AI System
The Law defines five categories of participants: developers, providers, deployers, users, affected persons.
Each participant bears different legal responsibilities throughout the entire lifecycle of an AI system.
2. AI Does Not Replace Human Responsibility
The Law emphasizes that:
- AI is merely a tool serving human purposes;
- Humans remain fully responsible for all actions and consequences caused by AI;
- AI systems must ensure effective human oversight and controllability.
3. Risk-Based Classification of AI Systems
AI systems are classified into:
- High-risk
- Medium-risk
- Low-risk
This classification serves as the basis for determining applicable legal obligations and required levels of regulatory oversight.
4. Transparency Obligations for AI-Generated Content
- Users must be informed when they are interacting with an AI system;
- Content generated by AI must be clearly labeled;
- Synthetic or simulated content (e.g. deepfakes, AI-generated voice) must be explicitly disclosed.
5. Liability in the Event of Incidents
- Enterprises must promptly report and handle AI-related incidents;
- Authorities may require suspension or withdrawal of the AI system;
- Obligations to compensate for damages may arise.
The 2025 Artificial Intelligence Law is not merely a legal regulation, but also a foundation enabling businesses to develop AI in a sustainable, transparent, and responsible manner.
