{"id":3555,"date":"2025-03-31T17:45:20","date_gmt":"2025-03-31T10:45:20","guid":{"rendered":"https:\/\/bnalegal.com\/?p=3555"},"modified":"2025-03-31T17:45:49","modified_gmt":"2025-03-31T10:45:49","slug":"khung-the-che-cua-viet-nam","status":"publish","type":"post","link":"https:\/\/bnalegal.com\/en\/khung-the-che-cua-viet-nam\/","title":{"rendered":"Vietnam's Institutional Framework"},"content":{"rendered":"<p class=\"has-medium-font-size wp-block-paragraph\">From 2018 to 2022, the Prime Minister issued Decisions aimed at enhancing environmental protection and reducing plastic waste. These documents focused on (i) national policies related to integrated solid waste management, the national green growth strategy, and the national environmental protection strategy, and (ii) policies to prevent plastic waste, especially ocean plastic waste. The common point of all the Decisions issued by the Prime Minister is the emphasis on the importance of environmental protection, green growth, and the reduction of waste into the environment.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Regarding general policies on plastic waste management, the Prime Minister's documents set goals to enhance the reduction, reuse, recycling, collection, and treatment of plastic waste.<em>. <\/em>The project to strengthen plastic waste management in Vietnam (Decision No. 1316\/QD-TTg dated July 22, 2021) outlines specific targets; by 2025, Vietnam aims to:\nUse 100% environmentally friendly plastic bags and packaging in commercial centers and supermarkets for daily activities, replacing non-biodegradable plastic bags. Ensure the collection, reuse, recycling, and treatment of 85% of generated plastic waste. Reduce 50% of plastic waste in the sea and oceans. Achieve 100% of tourist areas, tourist accommodations, and hotels not using non-biodegradable plastic bags and single-use plastic products. Gradually reduce the production and use of non-biodegradable plastic bags and single-use plastic products in daily activities. To implement this project, the Ministry of Natural Resources and Environment issued Decision No. 2436\/QD-BTNMT on a specific implementation plan. The implementation contents include: (i) Reviewing, amending, and supplementing legal documents within its authority or proposing the issuance of documents related to plastic waste management; (ii) Implementing training, communication, and international cooperation activities on plastic waste management; and (iii) Researching, applying technology, and deploying models and activities for plastic waste management and producing environmentally friendly products.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Regarding the issue of ocean plastic waste, in 2019, the Prime Minister issued Decision No. 1746\/QD-TTg on the National Action Plan. The goals set are that by 2025, Vietnam will reduce ocean plastic waste by 50% (this figure is 75% by 2030); 50% of discarded fishing gear will be collected (this target is 100% by 2030, and the direct disposal of fishing gear into the ocean will be ended); 80% of coastal tourist areas, tourist accommodation establishments, and other coastal tourism services will not use single-use plastic products and non-biodegradable plastic bags (this rate is 100% by 2030); 80% of marine protected areas will be free of plastic waste (the target for 2030 is 100%). The main solutions include: (i) raising awareness, responsibility, and changing habits of the fishing community and related parties; (ii) developing and completing state management documents on ocean plastic waste management; (iii) reducing plastic waste, collecting, sorting at source, reusing, recycling, and gradually replacing the use of specialized plastic items; (iv) scientific research, application, development, and transfer of technology related to ocean plastic waste management; and (v) enhancing international cooperation. To demonstrate Vietnam's determination on this issue, the Prime Minister issued Decision No. 1407\/QD-TTg on August 16, 2021, approving the project for Vietnam to proactively prepare and participate in the development of a global agreement on ocean plastic pollution. The Ministry of Natural Resources and Environment, the Ministry of Agriculture and Rural Development, and the Ministry of Health have issued documents to implement the Government's policies and assigned detailed tasks to their subordinate units.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Notably, the Ministry of Natural Resources and Environment has issued criteria for the Vietnam Eco-label for environmentally friendly plastic packaging, which includes descriptions of product types, criteria for raw materials, materials, fuels, and technical characteristics, and permissible limits of pollution parameters in products.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Thus, with the current legal documents, Vietnam has established an institutional framework for reducing plastic waste and actively participates in the process of developing international treaties on reducing ocean plastic waste.
